What We Collect And How We Use Information
At CAP Track Services, we are committed to protecting your privacy. When you register for our Access, we need to know some key information. This allows us to set up your password and to send you information about our services as quickly as possible. We may also use the information we collect to occasionally notify you about important functionality changes to the web site, new CAP Track Services services, and special offers we think you'll find valuable. CAP Track Services does not sell, trade, or rent your personal information to unaffiliated companies without your consent.

To help protect the confidentiality of your personally identifiable information, CAP Track Services employs security safeguards appropriate to the sensitivity of the information. Unfortunately no data transmission over the Internet can be guaranteed to be 100% secure.

CAP Track Services may not be able to provide you with access to your personal information where the information cannot be separated from the records of others, cannot be disclosed for reasons of security or commercial confidentiality, or is protected by legal privilege. An administrative fee may be applicable for access requests.

CAP Track Services also wants to ensure that the personal information it has in its possession is complete, accurate and current. Terms of Use

General
Welcome to the CAP Track Services web site, currently consisting of various web pages at or linked to the URL www.CAPTrack.ca (the "Site"), PLEASE READ THIS TERMS OF USE AGREEMENT CAREFULLY BEFORE USING THIS WEBSITE.

There are a variety of products and services ("Products and Services") offered through the Site that have particular procedures and terms of services that are supplementary to these Terms of Use. Please read these legal agreements carefully.

Acceptance
Your access to and continued use of the Site and related Products and Services constitutes your acceptance of, and is conditional upon your continued acceptance of and compliance with, these Terms of Use and any other posted procedures, guidelines or rules applicable to any individual Product or Service. All such procedures, guidelines and rules are hereby incorporated by reference in these Terms of Use. Also note that these Terms of Use and posted procedures, guidelines or rules may change from time to time. A record of the date of the latest change can be obtained by clicking on Changes. It is your responsibility to check for any such changes. If you do not agree to these Terms of Use, please do not use the Site or related Products and Services.

Permitted Use
Except as provided below, users are only permitted to use documents retrieved from the database of documents or other information made available to a user of this Web site for the user's own internal business or personal purposes and users cannot directly or indirectly, sell, copy, assign, provide access to, transmit  to any third party, or publish, repackage, retransmit, resell or otherwise disseminate, such database, or any portion thereof, in any medium in any manner whatsoever, nor can a user use such database, or any portion thereof, in any manner that may infringe any proprietary or intellectual property interests that CAP Track Services or any third party may have in such database. Notwithstanding the foregoing, a user may provide copies of documents retrieved from such database to bona fide clients who comply with the above restrictions on use of such database. A "bona fide client" is a client of a user principally for the purpose of receiving goods or services from a user, other than documents from CAP Track Services or other similar information, such that providing documents is only incidental to the primary business relationship between the user and such client. A user has no other rights to documents obtained through this Web site. Nothing contained in these terms and conditions shall be construed as conferring any right under copyright of CAP Track Services or any other person who holds copyright in content provided on this Site, as publication of materials on this Site does not constitute the placing of such materials in the public domain.

Database Subscriber Registration and Passwords
To have access to the Site, you must be a paid subscriber in good standing.  As part of the registration process, we will provide you with a username and password. We ask that you change the password on your first visit to the site. You agree that if you become aware of any unauthorized use of your Passwords, you shall immediately notify CAP Track Services in writing or via e-mail. Upon receipt of such notice, CAP Track Services shall take reasonable steps to stop any activity using the Passwords, and you agree that  neither CAP Track Services nor any of its directors, officers, employees, agents, representatives or affiliates can or will have any responsibility or liability to you or to any other person whose claim may arise from the unauthorized use of your Passwords.

Reserved Rights
All rights reserved. CAP Track Services and its affiliates either owns or has the intellectual property rights, including copyright, in the information and content contained on the Site and provided or distributed to members of the site by e-mail (the "Information"). " CAP Track Services " and all other trademarks, service marks, and logos used on the Site are the trademarks, service marks, or logos of their respective owners.

Users of the Site are granted permission to print and copy the Information for their own personal non-commercial use only, provided the Information is not modified and a copy of this agreement is attached to any copies that are made. Any other use of the Information is prohibited. None of the Information may be otherwise reproduced, republished or re-disseminated in any manner or form without the prior written consent of CAP Track Services.

No Solicitation
No part of the Site or related Products and Services should be taken to constitute an offer or solicitation to buy or sell securities and/or any products or services, unless otherwise expressly stated.

No Liability
In no event is CAP Track Services and its directors, officers, employees, agents, representatives or affiliates responsible for any direct, indirect, special, incidental, consequential, exemplary, punitive or any other damages whatsoever and howsoever caused, arising out of or in connection with the use of the Site and related Products and Services or in reliance on the Information and through related Products and Services or as a result of transmitting confidential information to CAP Track Services over the Internet, including any loss of use, lost data, lost business profits, business interruption, personal injury, contribution or indemnity or any other pecuniary loss, whether in an action of contract, negligence or other tortuous action, even if CAP Track Services has been informed in advance of the possibility of such damages or such damages could have been reasonably foreseen by CAP Track Services.

The provincial laws of the Province of Ontario and the federal laws of Canada applicable therein shall govern as to the interpretation, validity and effect of this Agreement, including, for greater certainty, all other legal agreements incorporated herein by reference, notwithstanding any conflict of laws provisions or your domicile, residence or physical location. By using the Site or any of the Information and Products and Services, you hereby irrevocably and unconditionally attorn to the jurisdiction of the courts of the Province of Ontario in any action or proceeding instituted under or related to this Agreement.

Termination
This Agreement shall remain effective until terminated in accordance with its terms. CAP Track Services may terminate this Agreement, and/or your access to and use of the Site or any portion thereof or any Products or Services, immediately, in the event we determine, in our sole discretion, that you have breached this Agreement. In any event, we reserve the right to terminate this Agreement without cause.

User Information Modification Policy
CAP Track Services offers members the ability to correct or change information collected during registration. Members who wish to change such information should contact CAP Track Services.

Representation as to Capacity to Participate
If an individual, you represent that your are of legal age and authorized to enter into this Agreement and participate and use the Site and the Products and Services. If an entity, you represent that you are duly formed, validly existing and have status in your jurisdiction of organization, have full power and authority to enter and perform this Agreement, and the persons agreeing hereto are fully authorized to act on your behalf. If you do not satisfy the foregoing criteria, please do not access or use the Site or Products and Services.

Technical and Software Requirements
To use CAP Track Services online services, you must have Internet access. We recommend Internet Explore as your browser of choice.

Some documents on the site may also be available in PDF format. To read these documents you will need to download and install Adobe Acrobat Reader.

English Language
It is the express wish of all parties that this Agreement and all documents, notices and other communications relating thereto be in English. Il est de la volont� expresse des parties que ce contract et tous les documents, avis et autres communications qui les concernent soient r�dig�s en langue anglaise.
